Welcome to WitnessIt, a civic complaint platform operated by WitnessIt. By using the WitnessIt mobile application ("App"), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the App.

1. About WitnessIt

WitnessIt enables citizens to report civic infrastructure problems — such as potholes, garbage accumulation, broken streetlights, water supply issues, and similar public concerns — directly to the relevant government authorities via email.

2. Eligibility

You may use WitnessIt if you are a resident of India. No account or registration is required. The App uses device-based identification (a unique device ID) to associate complaints with your device.

3. Acceptable Use

You agree to use WitnessIt only for:

• Reporting genuine civic infrastructure complaints
• Issues affecting public welfare (roads, sanitation, electricity, water, drainage, etc.)

You must NOT use WitnessIt for:

• Personal allegations, defamation, or targeting individuals
• False, fabricated, or misleading complaints
• Uploading manipulated, edited, or AI-generated photos as evidence
• Spam, duplicate, or frivolous submissions
• Any purpose that violates applicable Indian law

4. User Responsibilities

• Truthful reporting: All complaints must describe real, observed civic issues.
• Authentic photos: Only upload original, unaltered photos taken by you at the complaint location.
• Accurate location: Allow GPS access so complaints are tagged with the correct coordinates.
• One issue per complaint: Each submission should describe a single civic problem.

5. Platform Role & Intermediary Status

WitnessIt operates as an intermediary platform under Section 79 of the Information Technology Act, 2000. We:

• Transmit your complaint to the relevant government authority via email
• Do not modify, endorse, or guarantee the content of complaints
• Do not have control over government responses or resolution timelines
• Are not responsible for the accuracy of user-submitted content

6. Content Moderation & Takedown

We reserve the right to review, moderate, and remove any complaint that:

• Violates these Terms or applicable law
• Contains false, defamatory, or misleading information
• Includes inappropriate, obscene, or offensive content
• Targets individuals rather than civic infrastructure

Complaints flagged for review will be processed within 36 hours. We comply with takedown requests from authorized government agencies and courts in India.

8. Device-Based Identification

WitnessIt does not require user accounts. Your device is identified by a unique device ID stored locally on your phone. This means:

• Uninstalling the App may result in loss of your complaint history
• Complaints cannot be transferred between devices
• The device ID is used solely for rate-limiting and upvote deduplication

9. Intellectual Property

By submitting a complaint, you grant WitnessIt a non-exclusive, royalty-free license to use, display, and transmit your complaint content (including photos) for the purpose of operating the platform and routing complaints to authorities.

10. Disclaimer of Liability

To the maximum extent permitted by Indian law:

• WitnessIt is provided "as is" without warranties of any kind
• We are not liable for any damages arising from your use of the App
• We are not responsible for email delivery failures, government inaction, or third-party service outages
• We are not liable for any consequences of complaints filed through the platform

11. Termination

We may restrict or block access from any device that violates these Terms, without prior notice. Repeated false or malicious complaints will result in permanent device-level blocking.

12. Changes to Terms

We may update these Terms at any time. The updated version will be posted at this URL. Continued use of the App after changes constitutes acceptance of the revised Terms.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
